Swingers club owners sue township over ‘scheme to unconstitutionally violate’ their civil rights

SUMMIT TWP., MI — The developers and owners of a proposed swingers club are suing Summit Township over its “intentional scheme” to violate their civil rights.

Epicurean Developments and The Club at 4200 filed the lawsuit through the U.S. District Court Eastern Michigan District demanding a jury trial and a judgment against the township to recoup costs, interest, exemplary damages and attorney fees.

In the 162-page lawsuit filed Feb. 18, Epicurean Developments, owner of the building at 4200 Spring Arbor Road, and its attorneys accuse Summit Township of deliberately undermining the color of the law and the plaintiff’s federal rights.

In the documents, Epicurean Developments accuses Summit Township of seven counts, which include violation of due process and free speech, business defamation, breach of contract, breach of implied contract and wrongful interference.
